Determine the Energy Conservation Plan and Target

Pursuant to Section 11 (8) and (5) and Section 22 of the ECP Act 1992 (B.E. 2535) in combination with Ministerial Regulation that requires the owner of designated factory and designated building to determine the energy conservation plan and target and submit to DEDE in compliance with criteria, methods and timeline required in the Ministerial Regulation as stated below.

          1. The owner of designated factory / building shall determine the EC plan and target for designated factory or designated building and implement on energy conservation as determined in plan and target. 

          2. To determine the EC plan and target pursuant to theme 1, the owner of designated factory / building shall determine the EC measures and prepare the report in details as stated in Appendix 1 for designated factory or as stated in Appendix 2 for designated building and submit to DEDE at every three years.  The first report shall be submitted within one year counting from the day the Ministerial Regulation is effective (29th April 2006).

          3.   In case any of implementation in determining the EC plan and target has  characteristic or been classified in types required as regulator- engineer professional by engineering law or as a regulator- architect professional by the architect law of which the one has to conduct the job shall be the one with license of professional regulator-engineer or of professional regulator-architect.

         4.   To implement as stated in theme 2, if having a non-avoided reason causing a failure in data submission within the due date, the owner of designated factory / building may request on a timeline extension.   In case of having an appropriated reason, the director general of DEDE is authorised to approve the request as necessary.

Punishment Chapter for Violators

           In case the owner of designated factory / building did not determine the EC plan and target for submitting to DEDE, that violator shall be fined for not exceeding of 100,000  baht  (Section 56).

 Appendix 1:

Details on Preparing the EC Plan and Target Report for Designated Factory

         To implement the EC plan and target in designated factory as required by the EC standards, shall pursue as the following details.

         1. To endorse the report shall present the names with their countersigns on the endorsement as follows.

             (1)  the owner of designated factory / building in a report approval

             (2)  the PRE to endorse a report for data correctness

             (3)  the implementer who determined the EC measures to endorse as a reporter

         2. The EC plan and target  report shall comprise of

             (1)  primary data of factory

                   (a)  name of factory / juristic person

                   (b)  address

                   (c)  product type 

                   (d)  production quantity

             (2)  energy consumption in factory

                   (a)  fuel ( type, consumption/ yr, price)

                   (b)  electricity ( consumption/yr, peak demand)

             (3)  energy consumption prior to implementation the EC plan

             (4)  target on EC implementing by measures ( overall target, energy saving result and investment)

                   (a) target on energy conservation improvement

                   (b) quantitative target for improvement

                   (c) energy savings and value of energy saved

                   (d) investment cost

                   (e) analysis result in a return on investment (ROI)

             (5)  implementation plan by measure to fulfil the target as determined

             (6) details on data and auditing results of energy consumption and EC measures. 

Appendix 2:

Details on preparation of EC plan and target report for designated building

         To implement the EC plan and target as required by the EC standard, shall pursue as the following details.

         1. To endorse the report shall present the names with countersigns on the endorsement as follows.

             (1)  the owner of designated factory / building in a report approval

             (2)  the PRE to endorse a report for the data correctness

             (3) the implementer who determined the EC measures to endorse as the reporter

        2.  The EC plan and target  report shall comprise of

             (1)  primary data of building

                   (a) name of building / juristic person

                   (b) address

                   (c) no. of rooms for hotel

                   (d) no. of beds for hospital

                   (e) building area for all building categories ( gross area, air-conditioning area)

              (2) building energy consumption

                   (a) fuel (type,  consumption/yr and price)

                   (b) a proportion of fuel consumption by systems

                   (c) electricity ( consumption and peak demand)

                   (d) a percent share of electricity consumption in air-conditioning system, lighting and others

             (3)  energy consumption prior to implementation the EC plan

           (4)  target on EC implementing by measures ( overall target, energy saving result and investment)

                 (a) target on energy consumption improvement

                 (b) quantitative target on improvement

                 (c) energy savings and value of energy saved

                 (d) investment cost

                 (e) analysis result in a return on investment (ROI)

           (5)  implementation plan by measures to fulfil the EC target as determined

           (6)  details on data and auditing results of energy consumption and EC measures
